Driven by a frightening realization, Gardner Goldsmith is calling into question the very use of the term "rights". His worry began upon reading Antonin Scalia's majority decision in the recent "Heller" case, a battle over a DC gun ban that forced the Court Justices to offer their opinions as to whether the right to keep and bear arms enshrined in the US Constitution is REALLY an individual right, or if it's a "group right". Scalia spent 66 pages citing myriad historical evidence that the Founders did consider it an individual right, when all he had to do was use logic. Rights are always inherent to the individual, and not groups, because groups are always reduceable to the individuals who comprise them. In fact, the term "group" is merely a useful shorthand for "group of INDIVIDUALS". DUH. Then, when Scalia was all done going to all that effort to defend an individual right to keep and bear arms, he finished his opinion with a statement that, in effect states, "but, of course, rights can be attenuated by government." CAN YOU BELIEVE IT? Uh, lesson for Mr. Scalia: Rights are called such because, as Locke said, they morally CANNOT be attenuated by outside forces. They stand for things untouchable, that's why they're called RIGHTS! HEYUH, HEYUH. Gardner Goldsmith correctly recognized the dangers this kind of thinking hold in store for freedom, and spoke out the day the opinion was issued. But he has since begun synthesizing thoughts on the term "rights", ranging from Obama's belief that there is somehow such a thing as a "positive right" to the fruits of someone else's labor (this actually negates itself because if you don't have a right to your own property, yet have a right to someone else's, that would mean there is no such thing as property, and, therefore, you don't have a claim on your supposed claim to someone else's property. Or, to put it another way, if your neighbor has a claim on your property and you have a claim on his, that also means he has a claim on his own property and you have a claim on his. After all, what is his is yours, and what is yours is his -- make sense?)
